Candidate of the All Progressive Congress (APC) in the 11 April, 2015 general election for Phalga constituency 3 who polled the 2nd highest number of votes, Hon. Chima Nnokam has dragged INEC before the Federal High Court Sitting in Port Harcourt.
Hon. Chima in suit No: FHC/PH/CS/85/2018, is praying for the court to order that he is immediately issued with the certificate of return to represent Phalga Constituency 3 in the Rivers State House of Assembly,
INEC having failed more than 30 days as prescribed by Section 116 of the Constitution to conduct the by election to fill the vacancy created by exit of Hon.Victor Ihunwo of Phalga const. 3 Rivers State.
Justice Mohamed Turaki hearing the matter in Port Harcourt has granted an exparte application and ordered that the matter be heard by the vacation court because of its urgent nature.
The judge ordered that the defendant be put on notice and has adjourned the matter to the Aug 10, 2018 for hearing of the motion for interlocutory injunction restraining INEC from conducting the election slated for Aug 18, pending the substantive suit.
